Torito Rests Not in Peace: Texas Judge Rules Bury Ayala Now, Exhumation Maybe Later

San Antonio, TX (May 28th, 2015)– Tony ‘El Torito’ Ayala Jr. is deeply involved in a bitter fight, a brutal war even he could not have predicted would occur. The only problem is Ayala, 52, died two weeks ago. Texas District Judge Larry Noll has ruled Ayala’s body could be released to his mother Pauline Torres Ayala for a proper Christian burial.

Ayala’s girlfriend Jenna Lewis claims to be his common law wife, and will go to probate to prove she and Ayala, with whom she lived since his release from prison last year, were married. If successful, Lewis will seek to force Ayala’s family to pay for exhumation, and Lewis stated she will have Tony cremated in accordance with his stated wishes. Paperwork has been filed to move the pending probate court action from San Antonio in Bexar County Texas to Kerr County Texas, where Ayala resided with Lewis in a home on her property.

Texas is one of seven remaining states in the United States where a man and woman can become husband and wife without getting a marriage license or having a marriage ceremony. Once established, a common law marriage has the same legal effect as a ceremonial marriage. To have a common law marriage in Texas, you must do three things: one, agree to be married; two, live together as husband and wife; and three, tell others (hold yourselves out) you are married. This can be accomplished by telling other people you are married, introducing yourselves as a married couple, or doing something to make people think you are married-like signing credit cards as a married couple.
